Terms of Service

1. Who we are

MainQuest is operated by Shivam Banerjee, a sole proprietor, Dinkelbergstrasse 5d, 4132 Muttenz, Switzerland ("MainQuest," "we," "us," "our"). Email: betterme.global@gmail.com.

2. Acceptance of these Terms

These Terms of Service ("Terms") govern your use of MainQuest: the website at mainquest.page, the web app at mainquest.center, and the MainQuest iOS app (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service. Some features may come with additional rules shown where you use them; those form part of these Terms.

3. The Service

MainQuest helps you track habits, keep a diary, manage a calendar, set goals, coach your sleep, and talk to Alfred, an AI assistant that uses your MainQuest data to give personal answers. Features and plan limits (Free, Lite, Pro) are described at mainquest.page/pricing. We keep improving the Service, so features may change. If we remove something important from a paid plan, we will tell you in advance, and you may cancel.

4. Accounts

• You must be at least 16 years old (or the age of digital consent in your country) to use MainQuest.
• Give accurate information when you sign up and keep it current.
• Keep your login details safe. You are responsible for what happens under your account; tell us straight away if you think someone else has used it.
• One account per person, on as many devices as you like.
• You can delete your account at any time in Settings.

5. Subscriptions, billing and your right of withdrawal

• Paid plans renew automatically at the price and interval shown when you buy, until you cancel. Prices include any VAT that applies.
• Subscriptions bought on the web are billed through Stripe; you can manage or cancel them in Settings. Subscriptions bought in the iOS app are billed by Apple and managed in your Apple ID settings, under Apple's rules.
• If you cancel, the plan stays active until the end of the period you have paid for. We don't refund unused time, except where the law or Apple's or Stripe's refund rules require it.
• If a free trial is offered, its length and what happens when it ends are shown before you start it.
• We may change prices for future periods. We will tell you in advance, and you can cancel before the new price applies.
• Right of withdrawal (EU and UK consumers, web purchases).If you live in the European Union or the United Kingdom and subscribe on the web, you may withdraw within 14 days of buying, without giving a reason, by emailing us. Because the Service starts straight away, you ask us when you buy to begin immediately, and if you then withdraw, you pay for the days you used. For purchases in the iOS app, Apple's refund process applies.

6. Using the Service

We give you a personal, non-exclusive, non-transferable right to use the Service for your own non-commercial purposes while these Terms apply. MainQuest, including its design, text, software, Alfred's behaviour, and the MainQuest name and logo, belongs to us or our licensors. These Terms don't transfer any of those rights to you. You may not sell, rent, or sublicense the Service, copy or modify it, or reverse-engineer it, except as the law expressly allows.

7. Acceptable use

You agree not to:

• use the Service for anything illegal, or to harass, abuse, or harm others;
• try to gain unauthorised access to the Service, our systems, or other people's data;
• use automated means to create accounts or get around plan limits;
• use bots, scrapers, crawlers, or AI agents to copy the Service, its interface, text, design, or Alfred's behaviour and prompts, or to build a competing product from them;
• upload content that infringes someone else's rights or that you have no right to share.

8. Your content and feedback

You own what you write and create in MainQuest: your diary, habits, goals, and calendar. You give us permission to store, process, and transmit it only as needed to provide the Service to you, including sending relevant parts to Alfred's AI provider or our transcription provider as described in the Privacy Policy. We don't use your content to train AI models, and we don't sell it.

If you send us ideas or feedback, we may use them freely to improve MainQuest, without any obligation to you. Please don't send feedback you consider confidential.

9. AI-generated content and health disclaimer

Alfred's replies are generated by an AI model and can be wrong, incomplete, or unsuitable for your situation. Alfred is not a substitute for professional medical, mental health, financial, or legal advice. For anything serious, please talk to a qualified professional.

Sleep coaching and health scores are tools for building habits, not medical devices. They do not diagnose, treat, or monitor any medical condition, including sleep disorders. If you have concerns about your sleep or health, talk to a doctor.

10. Privacy

Our Privacy Policy explains what personal data we collect, how we use it, and the rights you have. It forms part of these Terms. If the two ever differ on how your personal data is handled, the Privacy Policy applies.

11. Third-party services

You can connect services run by others, such as Apple Health, Google, WHOOP, Strava, and Garmin, or sign in with Apple or Google. Their own terms and privacy policies apply to them. We are not responsible for their availability, accuracy, or how they handle your data.

12. The iOS app and Apple

If you use MainQuest on an iPhone or iPad downloaded from the App Store:

• These Terms are between you and MainQuest, not Apple. MainQuest, not Apple, is responsible for the app and its content.
• Your right to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store's usage rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app doesn't meet a warranty that applies, you may tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• MainQuest, not Apple, handles any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, and claims that it infringes someone's intellectual property.
• You confirm that you are not in a country under a U.S. government embargo or listed as a terrorist-supporting country, and that you are not on a U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Termination

You can stop using the Service and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these Terms, or where the law requires it. Where we can, we tell you first and give you a chance to fix the problem. If we close a paid account without a good reason in these Terms, we refund the unused part of the period you paid for.

14. Warranties

We work hard to keep MainQuest available, secure, and correct, but we can't promise that it will always be uninterrupted or error-free, or that every result (including Alfred's replies and health scores) will be accurate. As far as the law allows, the Service is provided as it is and as available. This doesn't affect any warranty rights that consumers have under mandatory law.

15. Liability

We are fully liable for damage we cause intentionally or through gross negligence, and for injury to life, body, or health. For slight negligence, and as far as the law allows, we are not liable for indirect or consequential damage, such as lost profits or lost data you could have backed up, and our total liability is limited to the amount you paid us in the 12 months before the event, or CHF 50 if you use the Free plan. Nothing in these Terms limits liability that mandatory law doesn't allow us to limit.

16. Governing law and disputes

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living outside Switzerland, you also keep the protection of the mandatory consumer law of the country where you live.

Please contact us first: most problems can be solved by email. If we can't agree, the courts at our place of business (Muttenz, canton of Basel-Landschaft, Switzerland) have jurisdiction. If you are a consumer, you may also bring a claim in the courts where you live, and we can only bring claims against you there. The European Commission no longer runs an online dispute resolution platform, and we don't take part in consumer arbitration.

17. General

• Changes to these Terms. We may update these Terms as the Service develops. We change the date at the top, and for important changes we tell you in the app or by email at least 14 days before they apply. If you don't agree, you can cancel and delete your account before then.
• Electronic communication. We may contact you by email or in the app, and these messages count as written notice.
• Transfer. We may transfer these Terms to a company that takes over MainQuest (for example, if Shivam Banerjee incorporates it), and will tell you if we do. Your rights under these Terms and the Privacy Policy stay the same.
• Severability. If part of these Terms is invalid, the rest still applies, and the invalid part is replaced by the valid rule closest to what was intended.
• Entire agreement. These Terms, the Privacy Policy, and any rules shown for specific features are the whole agreement between you and us about the Service.
